Terms and Conditions 

These Terms and Conditions (as defined below) govern the use of sharkninja.com.hk (hereinafter "the website") and the purchase of any goods from it. The website is owned by SN APAC Holding HK Limited (Business Registration Number: 76136952) (hereinafter “SN APAC”)  

The sale of goods through the website is conducted by LUXASIA (H.K.) Limited (Business Registration Number: 15488053) (hereinafter "LUXASIA"), the authorized exclusive distributor of SN APAC in Hong Kong. All contracts for the sale of goods are entered into between you and LUXASIA. SN APAC is not a party to any contract of sale and shall not be liable in respect thereof, save for any liability arising from product defects or intellectual property matters as set out herein. 

References to "we", "us" or "our" in these Terms and Conditions shall refer to: (a) SN APAC, in respect of matters relating to the ownership of the website, its content, intellectual property rights and product information; and (b) LUXASIA, in respect of all matters relating to the sale, fulfilment, delivery, returns and after-sales service of goods purchased through this website. 

Your purchase is fulfilled by LUXASIA, an authorized exclusive distributor of SN APAC in Hong Kong. For the avoidance of doubt, SN APAC's obligations and liabilities under these Terms and Conditions shall not extend beyond the provision and updates of this policy and the intellectual property scope of the product as set out herein. 

 

Acknowledgment and acceptance of Terms and Conditions 

SN APAC and/or LUXASIA reserves the right to amend or update this website, including but not limited to the Terms and Conditions of Supply (as described below), and all disclaimers and limitations of liability published on the website (collectively, the "Terms and Conditions"). Any changes will be notified to you by posting the revised version on the website, with the effective date of the revised Terms and Conditions clearly indicated. The revised Terms and Conditions shall apply to orders placed on or after the effective date. Orders placed prior to the effective date shall continue to be governed by the Terms and Conditions in force at the time of such order. Your continued use of the website after the effective date of any amendment constitutes your acceptance of the revised Terms and Conditions. By using the website, you acknowledge that you have read and understood these Terms and Conditions in their entirety. 

Terms and Conditions of Supply 

All contracts for the sale of goods from the website shall incorporate these Terms and Conditions of Supply. Neither the performance, in whole or in part, of a customer’s order (hereinafter called “the buyer”) nor any other conduct on the part of SN APAC and/or LUXASIA shall be construed as an acceptance of any terms or conditions inconsistent with these Terms and Conditions of Supply. Any variance must be agreed in writing by the parties. 

  • Payment shall be made in full prior to the dispatch of goods. 

  • Orders are fulfilled and dispatched by LUXASIA. Applicable shipping fees will be calculated and charged at checkout. 

  • The price payable for goods shall be as confirmed at the time your order is accepted by LUXASIA. In the event that applicable statutory taxes or duties are increased by governmental authorities after order acceptance but prior to dispatch, LUXASIA will notify you of the revised amount. You shall have the right to cancel your order and receive a full refund within 14 business days of receiving such notification. If no cancellation is received within such period, you will be deemed to have accepted the revised price. 

  • All sales are made outright. Title to the goods shall pass from LUXASIA to the buyer upon full payment and dispatch of the goods.  

  • Statutory Returns: Where goods are defective, not of satisfactory quality, or do not conform to their description, you are entitled to remedies in accordance with applicable laws in Hong Kong. LUXASIA will, at its option and as required by applicable law, provide a repair, replacement or refund. No processing fee will be charged for such returns. Any return of goods other than Statutory Returns may be subject to a processing fee determined by LUXASIA based on the actual costs incurred. All claims for incorrect, damaged or short deliveries must be made to LUXASIA within 10 days of receipt of goods, quoting the relevant order reference. Nothing in this clause shall affect any statutory rights you may have under applicable laws, and subject thereto, claims made after this 10-day period may not be accepted. 

  • The buyer acknowledges that LUXASIA may use their personal data to send them marketing communications via email, SMS, phone, or other channels, where express consent has been obtained in accordance with the Personal Data (Privacy) Ordinance (Cap. 486). The buyer may opt out at any time. 

  • LUXASIA reserves the right to charge freight on all orders under HKD1,000. Orders of HKD1,000 or above are excluded from freight charges. 

  • The buyer acknowledges they have had a reasonable opportunity to obtain independent legal advice in relation to these Terms and Conditions of Supply.

Our Security Policy 

We want to ensure you can shop online with complete confidence. We implement various measures to provide security to our customers in their dealing with us. 

Credit Card Security & Fraud 

Our online credit card payment system is powered by Shopify’s secure payment gateway, which uses industry-standard encryption technology to ensure all transactions are safe and protected. Payments are processed through trusted global payment partners and financial institutions in Hong Kong. 

This provides a secure environment for you to complete your purchase using your credit card. Your payment details are encrypted and handled securely, and they are not accessible to, nor stored by us. 

While we maintain robust internal security, credit card fraud is often created by access gained to your credit card details by other means. Your credit card details could be compromised and used to purchase goods without your knowledge. Any suspected or alleged credit card fraud may be subject to investigation and chargeback procedures in accordance with the applicable rules and procedures of the relevant issuing bank and card networks. Your bank will usually refund you immediately (less any charges they may apply). We are committed to maintaining the reliability and credibility of our platform to ensure a secure shopping experience. 

Limitation of Liability 

(a) Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights that you may have under applicable laws in Hong Kong that cannot be excluded, restricted or modified by agreement, including rights under the Sale of Goods Ordinance (Cap. 26) ("Non-Excludable Rights"). 

(b) Subject to clause (a) above, LUXASIA's liability to you in connection with goods or services supplied through this website shall, to the maximum extent permitted by law and at LUXASIA's election, be limited to: (i) the replacement of the goods during the first twelve (12) months following the date of purchase; and (ii) the repair of the goods during the subsequent twelve (12) months.

The information contained on the website is provided by SN APAC and LUXASIA in good faith. To the best of their knowledge, the information is accurate and current. 

However, SN APAC and its related bodies corporate, including any of their directors, officers, employees, consultants or shareholders ("SN APAC’s Associates") and LUXASIA do not make any representation or warranty as to the accuracy or completeness of the information. To the fullest extent permitted by applicable law, SN APAC AND LUXASIA disclaim all representations and warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose and non-infringement. SN APAC and LUXASIA make no warranty that this website, any information or ideas contained on this website or any products or services will meet your requirements. You expressly acknowledge and agree that SN APAC and LUXASIA do not control links with this website and are therefore not liable for the opinions or behaviour of such links, including any information or advice provided by them or any defamatory statements made by them or any offensive conduct on their part. 

You further acknowledge and agree that, subject to the section on "Limitation of Liability", SN APAC and LUXASIA will not be liable to you or any other person for any direct, indirect, incidental, special, consequential or exemplary damages resulting from the use of goods or services supplied to you, or on behalf of you, through the website.

provided that such indemnification shall not apply to the extent that such claims arise from the gross negligence, willful misconduct or violation of law by SN APAC, its Affiliates or LUXASIA. 

Nothing in these Terms and Conditions shall exclude or limit any liability that cannot be excluded or limited under applicable law. 

Discount Codes 

Only ONE discount code is applicable to be entered at the checkout. Discounts cannot be combined and only one offer can be applied to any order. The use of discount codes is subject to any specific promotion terms published on the website, which are incorporated into these Terms and Conditions.
